Article 1 User’s responsibilities and rights

1. 1. The user shall use this service on his/her own responsibility and agree to assume all responsibilities for any act in violation of the duties based on the terms of use, any act that was conducted by using this service and damages (including damages that our company may sustain) that was caused by such an act.
2. 2. The user's right of use is non-exclusive, and sublicensing, assignment or succession of the contractual status to a third party is not allowed.
3. 3. The user shall prepare the equipment (including smart phones, tablets) and the network environment required for operation of this service at his/her own expense and on his/her own responsibility.

Article 2 Usage fee

This service is provided free of charge.

Article 3 Acquisition and use of information about the user

This service acquires and uses part of information about the user. The information about the user acquired in this service is handled as described in each section below. The user shall understand and approve them.

1. 1. This service automatically acquires the following information about the user and uses it for the following purpose:
   1. (1) Use history and operation history of this service, questionnaire survey results
      • ・ For the purpose of survey and analysis of usage situations
2. 2. In addition to being used for the purpose described in the previous section, the information about the user may be provided to our group companies and other companies as long as it does not allow individuals to be identified or it has been processed into a state that does not allow individuals to be identified. Statistically processed information may be made public.
3. 3. Information about the user prescribed in Sections 1 and 2 is sent to our server and used within the scope of the purpose.
4. 4. This service allocates dedicated identification information to the user or his/her terminal. This information is exchanged between this service and our server and shared for use.

Article 4 Prioritizing the current state

1. 1. If the information provided to the user by this service (documents, video, audio, photos, images and all other edited contents) is different from the current state at stations on our company's subway lines, the current state shall be prioritized.
2. 2. Our company does not assume any responsibility for damages sustained by the user or third parties due to a discrepancy between the information provided to the user by this service (documents, video, audio, photos, images and all other edited contents) and the current state at stations on our company's subway lines.

Article 5 Intellectual property rights

1. 1. The intellectual property rights (including, but not limited to, copyrights, patent rights, utility model rights, design rights, trademark rights, know-hows, etc. The same shall apply hereafter.) of the information displayed by this service (documents, video, audio, photos, images and all other edited contents) shall be held by our company or third parties.
2. 2. Licensing this service to the user under the terms of use does not mean transfer of any right to the user.

Article 6 Prohibitions

The user shall not conduct the acts described below when using this service. If our company or any third party suffers damages due to a misconduct of the user, the user shall bear the responsibility for compensating for the damages.

1. 1. Use of this service by any procedure other than the procedure approved by our company.
2. 2. Use of this service for the commercial purpose or for profit beyond the scope of the personal use.
3. 3. Act that causes interference with or trouble in the operation of this service (or the server and network connected to this service).
4. 4. Use of this service with impersonation of a third party.
5. 5. Reproduction, reprint, redistribution or the like of any of images, data and information used in this service, without prior written permission of our company, whether with or without consideration or regardless of form.
6. 6. Infringement of any intellectual property right such as a copyright, a patent right, a utility model right, a design right, a trademark right or know-how of our company or third parties.
7. 7. Inappropriate act conducted for the purpose of obtaining any privilege or the like.
8. 8. Other acts that our company judges as inappropriate based on rational reasons.

Article 7 Disclaimer

This service is provided as is. Our company does not guarantee any of integrity, utility, operation, suitability for certain purposes, compatibility to a device in use, and other matters of this service. Our company does not assume any responsibility for damages sustained by the user or third parties due to a communication failure, defect or trouble of the system equipment or the like, or use of this service.

Article 8 Change, interruption or termination of this service

The user shall not conduct the acts described below when using this service. If our company or any third party suffers damages due to a misconduct of the user, the user shall bear the responsibility for compensating for the damages.

Our company may change the contents, display, operation procedures, management method, etc. of this service or interrupt or terminate the provision of this service without prior notification to the user. In this case, our company does not assume any responsibility for any event caused by such change, interruption or the like.
2. 2. If the user violates any of the provisions specified in the terms of use, our company shall be able to cancel the terms of use with the user without any notification and make the user terminate the use of this service.

Article 9 Change of the terms of use

1. 1. The terms of use may change without obtaining prior approval from the user and without notice. If the user uses this service after it is changed, the user shall be regarded as having agreed to the change.
2. 2. When the terms of use have been changed, our company notifies the user or makes an announcement in a manner that our company judges as appropriate, such as posting on the website.

Article 10 Governing laws and jurisdiction

The terms of use shall be governed by the laws of Japan. The Tokyo District Court shall have exclusive jurisdiction by consent of the first instance with respect to all disputes between our company and the user arising out of or in connection with the terms of use or this service.

The terms of use shall come into effect on March 22, 2018.
